Finical Holdings (“we,” “us,” “our,” or “Finical”) collects information about you when you visit our website located at www.finicalholdings.com (the “Site”) or access or use our products and services (collectively, the “Services”) and through other interactions and communications you have with us. 1) How Do We Use The Information You Provide Us?

I) Your Personal Information or financial information may be passed on to a third party in the event of a transfer of ownership or assets of Finical or a bankruptcy. We may also disclose Personal Information or financial information when we determine that such disclosure is necessary to comply with applicable law, to cooperate with law enforcement or to protect the interests or safety of Finical or other visitors to the Site. Whenever Personal Information or financial information is disclosed under this paragraph, we may also disclose your demographic information on a non-anonymous basis.

3) How Does Finical Protect Your Personal Information?

B) Please be aware that emails or other messages you send to us (outside of any secure communication features provided within the Site) are not necessarily secure against interception and you should not include sensitive information in those messages. We generally will not ask for your bank account number, password or other sensitive information in an email and you should assume that if you get such a request, it might be fraudulent.

5) Does Finical Use Tracking Technology?

6) How Do You Change Personal Information Provided or OPT-OUT?
Finical gives you an option for modifying or removing your information from our database. To update, modify or delete the information that we have on file for you, please edit your account profile information. However, please note, that while you may remove your Personal Information from the Site at any time, you acknowledge that we may retain archived or cached copies of your Personal Information. 7) How Long Do We Keep Your Information?
Following termination or deactivation of your account, Finical may retain your Personal Information for a commercially reasonable time for backup, archival, or audit purposes. 9) Changes.
